2. Accuracy of information
Every effort is made to be sure the information presented in this website is accurate and up to date. However, the cars, products and services offered through our website are subject to regular revisions and improvements to provide a better experience for our customers. As such, standard specifications and other details may vary over time, and all information on this website should be considered for information only. We reserve the right to alter the specification of products and services without notice. We strongly recommend that you confirm the details of any product or service with elms Direct staff before committing to buy or make use of our products or services.

3. Your rights when buying at a distance
We offer cars for sale over the internet as well as to customers visiting one of our dealerships in person. Any transaction which take place at a distance (either over the telephone, email, internet, fax or other means of distant communication) is subject to The Consumer Protection (Distance Selling) Regulations 2000. We abide in full by these regulations. More detail on the legal rights these regulations provide can be found here.
4. The Seven-Day Money Back Guarantee
Customers buying a new or used car through the elms Direct website may return the car within seven days of purchase, whether or not the car has a fault (“The Seven-Day Money Back Guarantee”), in accordance with Consumer Protection (Distance Selling) Regulations. We also offer this guarantee to customers who buy in person through one of our dealerships. For these customers, the Seven-Day Money Back Guarantee is in addition to their legal rights. In all cases, if a customer wishes to return the car it must be in undamaged condition, complete with all the items and accessories included with the car when purchased (including but not limited to the vehicle handbook, all keys, tool kits, locking wheelnuts, the service booklet and so on). The vehicle must have covered no more than 500 miles since purchase.
5. Part-exchanging your old vehicle
We will consider any car as a part exchange. The paperwork which we will need to see before accepting a vehicle in part exchange is described in the FAQ section of this website. For customers who live more than 50 miles from one of our dealerships, we can offer part-exchange valuations over the telephone. However, these valuations are dependent on the accuracy of the information supplied to us by the customer. If we subsequently find any inaccuracies or omissions in the vehicle’s description, whether deliberate or otherwise, we reserve the right to alter the part-exchange valuation. Any shortfall in payment for the vehicle to be purchased must be met by the customer in full.
6. Delivering your vehicle
We can deliver cars anywhere within mainlandBritainat no extra cost to our customers. This can usually be arranged within three days of full payment for the vehicle but may take five days or longer and is carried out by a fully trained and insured plate driver. There is a premium trailer option available which must be requested when an order is placed and is chargeable at £1.50 per mile. If a vehicle is delivered to a customer who is part-exchanging their old car the transaction can only be completed once the part exchange has been assessed and found to be as to us described by the customer over the phone. If the vehicle is not as described we reserve the right to alter the part-exchange valuation and will charge the customer for the shortfall. This additional payment must be made before the delivery driver can release the new car. If the payment is not made, delivery cannot be completed and a penalty charge of £100 will apply.

7. Fuel economy figures
Fuel economy statistics are provided in accordance with European Union Directive 93/116/EC. These statistics are provided for information only and should not be taken as a guarantee of the actual fuel economy which will be achieved. Fuel economy will vary depending on driving style, road conditions, tyre inflation pressures and so on.
8. Speed and road safety
Any reference to a vehicle’s top speed, acceleration or cornering performance does not constitute an encouragement to drive dangerously, to break speed limits or to infringe any road traffic regulations. This website is not a substitute for the important road safety information contained in the vehicle’s handbook.
9. Intellectual property, copyright and trademarks
We assert all our rights regarding the intellectual property of the content of this website. This includes copyright, design rights, database rights, source codes and other forms of intellectual property which are owned by us or licensed to us. Visitors to this website may display this information on their computer screen, and download it in order to print it to create a hard copy for their own use.
However, visitors to this website must not:
- Copy, download, or distribute any text, image, illustration, icon, graph or video, or copy any underlying source code or software, for any public or commercial purpose, without our prior written consent or the consent of the copyright holder.
- Alter or remove any trademark, copyright or proprietary notices.
- Use this website to upload computer viruses or any other form of damaging material which will hinder or disrupt this website or its services.
10. Reliability of this website
Every effort is made to ensure this website works reliably at all times. However, it may sometimes be necessary to close some or all of the website for maintenance. We reserve the right to change these terms and conditions at any time and without prior notice. The updated terms and conditions will be posted on this website and will immediately supersede these terms and conditions governing the use of this website upon posting.
13. Survival of conditions
If any provision contained in these terms and conditions becomes illegal, invalid or unenforceable under the laws of any state or country in which we trade, it shall be removed from the terms and conditions. All other terms and conditions will continue to apply.
These terms and conditions will be governed and construed solely under the laws ofEngland. The courts ofEnglandshall have jurisdiction to resolve any dispute regarding the terms and conditions.
